When I formed this firm in January 2006, my goal was to shift my focus away from my legal practice to develop and grow a cross-border legal and international business advisory practice. I have achieved that goal.  100 percent of my practice and services involve providing trusted cross-border advisory and consulting services to my clients.  I divide my time between my Greenwich, Connecticut base and overseas (mostly in Asia).

Services

My clients and friends can attest that I am an “out of the box” thinker and practitioner. My approach to my profession were certainly influenced by my upbringing as the son of a career US Foreign Service officer and from living in Europe and the Middle East. Living and traveling overseas, I was exposed to many cultures, languages and societies which helped me to develop and enhance my “listening” and communication skills. In addition, my over 50 years of active martial arts practice has also influenced my professional development as martial arts practice, at its core, is just another form of communication. The same could be said with my guitar practice and wide interest in many types of music.
While the list of current and completed engagements reflected on the Services page can provide more detail on my experience and services, the following is a summary of the kinds of services I can provide and have provided to my clients:

  • Trusted cross-border adviser and counselor to C-suite executives and professionals.
  • Serving as a chapter 11 Trustee (or in the case of Thailand, serving as the Court approved “Planner”) in challenging cases involving assets, commercial disputes and operations outside of the US.
  • Serving as a cross-border mediator, mediation advocate and as the lead negotiator and facilitator to manage and resolve commercial disputes.
  • Managing dispute resolution matters in offshore jurisdictions, which services include: selecting and managing teams of local professionals and business advisers to ensure that they are performing cost-effective and efficient services, providing strategic advisory guidance to my clients and providing instructions to local team members based on my professional knowledge and experience, knowledge of the foreign legal, regulatory and cultural environment, and serving as the lead facilitator and negotiator to close transactions and resolve disputes.
  • Assisting my clients and their professionals in the enforcement of judgments and arbitral awards in SE Asia and China, which services include the identification and retention of local resources for asset tracing and teaming up with local business advisers to engage in settlement discussions with the relevant parties to attempt to achieve negotiated settlement agreements out of court.
  • Serving as a director, liquidator or legal representative of foreign subsidiaries of US parents that are in distress to manage the orderly wind-down of these entities.
  • Assisting my C-suite clients as a counselor in connection with their expansion of existing operations, shifting production to other or new operations in the region and their “exit” strategies in SE Asia and China.

Professional Relationships

I would not be able to provide effective and efficient services for most of my engagements without the assistance of trusted professional and business advisory team members. Over the years, I have built a robust contact list of people and firms that I can call on for assistance with my client engagements. On a case by case basis, I first identify the individuals and teams needed for the engagement and then ask my clients to either engage these individuals or teams directly to serve as team members under my direction or, in other instances, I retain firms and individuals as independent contractors under my platform and engagement.
